The centrality of the territorial issue in the legislative offensive against indigenous peoples
A centralidade da questão territorial nas ofensivas legislativas contra os povos indígenas
Abstract
Este artigo se propõe a construir uma breve reflexão sobre as ofensivas legislativas contra os direitos indígenas, fazendo notar a centralidade da questão territorial. Esses ataques tomam a forma de projetos de leis e propostas de ementas constitucionais que visam alterar artigos específicos da legislação que protegem o direito indígena à terra e agilizam sua demarcação. Ao mesmo tempo, recorre-se à construção discursiva sobre a bestialidade do índio seguida pela tentativa de criminalização daquilo que se convencionou chamar de infanticídio indígena. Busca-se, com isso, criar manobras que retardem ou inviabilizem a demarcação das terras tradicionalmente ocupadas, ou a gestão desses territórios. O avivamento desses embates no Legislativo decorre da formação e fortalecimento de um bloco de parlamentares que, ligado ao agronegócio, faz oposição direta aos direitos indígenas assegurados pela Constituição Federal de 1988.
